{"id":29958,"date":"2025-06-09T00:00:00","date_gmt":"2025-06-08T23:00:00","guid":{"rendered":"https:\/\/csw-yeo.1wp.site\/press\/delhi-high-court-upholds-army-decision-to-dismiss-christian-lieutenant-for-6539\/"},"modified":"2026-09-23T19:13:52","modified_gmt":"2026-09-23T18:13:52","slug":"delhi-high-court-upholds-army-decision-to-dismiss-christian-lieutenant-for-6539","status":"publish","type":"press","link":"https:\/\/www.csw.org.uk\/es\/press\/delhi-high-court-upholds-army-decision-to-dismiss-christian-lieutenant-for-6539\/","title":{"rendered":"Delhi High Court upholds army decision to dismiss Christian lieutenant for refusing to participate in Hindu rituals"},"content":{"rendered":"<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"\/wp-content\/uploads\/2026\/09\/5e0e08ec0472357d123fbcb24b48497a.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><b>On 30 May the Delhi High Court <a href=\"https:\/\/timesofindia.indiatimes.com\/india\/delhi-high-court-upholds-army-officers-termination-for-refusing-to-attend-religious-parade\/articleshow\/121542640.cms\">upheld<\/a> the Indian Army&#8217;s decision to dismiss a Christian lieutenant for refusing to take part in certain Hindu religious rituals practiced by his regiment.<\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lieutenant Samuel Kamalesan joined the army in 2017 and served in the 3rd Cavalry Regiment, which predominantly recruits soldiers from the Jat, Rajput and Sikh communities. While he did attend religious parades and festivals at the unit\u2019s temple and gurdwara, shortly after his recruitment he sought an exemption from entering the temple\u2019s inner sanctorum to perform the <em>puja<\/em>Hindu worship ritual, claiming that it went against his Christian beliefs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lt Kamalesan has faced disciplinary action ever since, and was dismissed in 2021 after several warnings, leaving him with no access to his pension entitlement and gratuity benefits. In a <a href=\"https:\/\/indiankanoon.org\/doc\/119072309\/\">statement<\/a> submitted to the Delhi High Court, the army argued that the traditions Lt Kamalesan sought exemption from are important for building unity and morale in the regiment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 30 May the Delhi High Court ruled that Lt Kamalesan\u2019s dismissal was lawful. The judges <a href=\"https:\/\/indianexpress.com\/article\/cities\/delhi\/delhi-hc-army-religion-indiscipline-10041622\/?utm_source=Taboola_Recirculation&#038;utm_medium=RC&#038;utm_campaign=IE&#038;tbref=hp\">stated<\/a> that following orders in the military comes above personal religious choices, and that unity in the armed forces is built through shared traditions, not divided by religion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lt Kamalesan had also raised the issue that his regiment did not have a common prayer space for members of all religious groups, in what appears to be the first recorded case of such a complaint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CSW\u2019s Founder President Mervyn Thomas said:<b><i> \u2018The Delhi High Court\u2019s decision in this matter raises challenges where individual faith confronts military directives. In the current climate such decisions could impact religious minorities who serve in the Indian army, exposing them to pressure and discrimination.
