{"id":29546,"date":"2021-12-15T00:00:00","date_gmt":"2021-12-15T00:00:00","guid":{"rendered":"https:\/\/csw-yeo.1wp.site\/press\/vietnamese-activist-sentenced-to-nine-years-in-prison-5510\/"},"modified":"2026-09-18T21:52:44","modified_gmt":"2026-09-18T20:52:44","slug":"vietnamese-activist-sentenced-to-nine-years-in-prison-5510","status":"publish","type":"press","link":"https:\/\/www.csw.org.uk\/zh\/press\/vietnamese-activist-sentenced-to-nine-years-in-prison-5510\/","title":{"rendered":"Vietnamese activist sentenced to nine years in prison"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"\/wp-content\/uploads\/2026\/09\/a6e6a670a75f931256822fd0669bc1fd.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><b>Vietnamese activist and journalist Pham Doan Trang has been sentenced to nine years in prison.<\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She was convicted of anti-State propaganda under Article 88 of the Criminal Code at a one-day trial on 14 December.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trang\u2019s mother and brother were allowed to enter the courthouse, but police stopped activists attending the trial, confining some to their homes. The harsh sentence of nine years is even longer than the prosecutors\u2019 recommendation of seven to eight years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pham Doan Trang was arrested on 7 October 2020 and was not permitted to meet with her lawyer until 19 October 2021. After a second visit, lawyer Mr Le Van Luan posted on his <a href=\"https:\/\/www.facebook.com\/HienTheVoHinh\">Facebook<\/a> page that Trang had been examined for health problems following appeals made to authorities by her defence team, and that an ultrasound had revealed she had a small tumour. Her trial was initially scheduled to take place on 4 November 2021 but was <a href=\"https:\/\/www.csw.org.uk\/2021\/11\/02\/press\/5465\/article.htm\">postponed<\/a> when the prosecutors in her case contracted COVID-19.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a <a href=\"https:\/\/www.thevietnamese.org\/2021\/12\/pham-doan-trangs-final-statement-at-her-trial\/\">letter<\/a> published by online magazine <i>The Vietnamese<\/i> on the day of the trial, Trang wrote: <b><i>\u201conly extremely foolish and heinous governments would try to extinguish it [pluralism] through repression and the imprisonment of dissidents, writers, journalists, social critics, and democracy and human rights activists\u201d.<\/i><\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pham Doan Trang has a long history of peacefully advocating for freedom and human rights in Vietnam as an independent journalist, and the founder of an environmental rights group and several independent media outlets. In 2017, Trang and other writers produced a <a href=\"https:\/\/www.thevietnamese.org\/wp-content\/uploads\/2017\/11\/Report_on_FoR_Vietnam_10_2017.pdf\">report<\/a> on the right to freedom of religion or belief (FoRB) in Vietnam. The report concludes that \u201cno religions (Buddhism, Catholicism, Protestantism, Hoa Hao Buddhism, Caodaism, Muslim, etc.) or beliefs can fully enjoy the right\u201d to FoRB in Vietnam.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 29 October 2021, UN human rights experts <a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=27734&#038;LangID=E\">called<\/a> on Vietnam to immediately and unconditionally release Trang, saying that she was \u201conly the latest victim of the authorities\u2019 use of vaguely defined propaganda charges to persecute writers, journalists and human rights defenders, criminalising the exercise of their right to freedom of opinion and expression to share information.\u201d They also said that \u201cBringing criminal charges against people who report on human rights issues is likely to coerce individuals into submission and silence, and preclude them from speaking out on such topics\u201d. The UN\u2019s Working Group on Arbitrary Detention had previously deemed Ms Pham Doan\u2019s detention arbitrary in an <a href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/Detention\/Opinions\/Session91\/A_HRC_WGAD_2021_40_AdvanceEditedVersion.docx\">Opinion 40\/2021<\/a> adopted in September 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Vietnamese government routinely imprisons individuals for human rights work including exposing corruption, organising peaceful protests, and using social media to advocate on social issues. Today two more activists, land rights activists Trinh Ba Phuong and Nguyen Thanh Tam, were sentenced to ten years in prison with 5 years\u2019 probation and 6 years in prison with 3 years\u2019 probation respectively. Two more activists are set be tried this month, anti-corruption activist Do Nam Trung, and blogger Le Trong Hung.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CSW\u2019s Founder President Mervyn Thomas said: <b><i>\u201cThis nine-year sentence is outrageous;<\/i><\/b><b><i>Pham Doan Trang is being targeted for her work peacefully promoting social justice and human rights in Vietnam. We concur with the conclusion of the UN human rights experts that Trang is one of many victims of the Vietnamese authorities\u2019 use of vaguely defined propaganda charges, which effectively criminalise the exercise of the right to freedom of opinion and expression. We call on the Vietnamese authorities to drop all charges against Pham Doan Trang and to release her immediately and unconditionally. We further call on the government to release all those detained or imprisoned in retaliation for exercising their human rights or defending the rights of others, including the right to freedom of religion or belief.
